TreeDM respects personal preferences regarding the collection and use of personal information. The following TreeDM privacy policies align with the different ways in which the various lines of business of TreeDM collect, use, share, and process your personal information:

INTRODUCTION

This general Privacy Policy of TreeDM (also referred to as ‘Privacy Policy’) provides information about the collection, use, and sharing (collectively, the “processing”) of personal information by Tree Digital Marketing and its affiliates (“TreeDM,” “we,” “us,” or “our”) in relation to your use of TreeDM’s websites, mobile applications, and social media pages that link to this Privacy Policy, your interactions with TreeDM during in-person meetings or at TreeDM facilities or events, or in the context of other online and offline sales and marketing activities. This Privacy Policy also details the privacy rights available to you concerning these processing activities.

This Privacy Policy was last updated on June 6, 2022. However, the Privacy Policy may change over time to, for example, comply with legal requirements or cover changing business needs.

In this document, “personal information” or “personal data” refers to information related to an identified or identifiable person. This includes, among other data, your name, address, email address, business contact details, or information collected during your interactions with us through our websites or events. Your personal information is also referred to as “your information.” If you want more details about the types of personal information we may process, please see Section 4 below.

SCOPE

This Privacy Policy applies to the processing of information by TreeDM from:

  • Visitors and users of the various TreeDM sites, including our websites on TreeDM.com, mobile and desktop software applications, and our social media pages that refer to this Privacy Policy (collectively, the sites);
  • Attendees of TreeDM events or events sponsored by TreeDM;
  • Current and potential customers and their representatives;
  • Subscribers to TreeDM publications and newsletters;
  • Visitors to TreeDM facilities; and
  • Suppliers and business partners and their representatives.

The Privacy Policy does not apply to the following activities:

  • Personal information collected about you by TreeDM customers.
  • Personal information you provide on third-party sites not controlled by TreeDM.

WHO IS RESPONSIBLE FOR YOUR PERSONAL INFORMATION?

Tree Digital Marketing and its affiliated entities are responsible for processing your personal information as described in this Privacy Policy.

WHAT CATEGORIES AND SPECIFIC DATA OF PERSONAL INFORMATION ARE PROCESSED?

TreeDM may process information collected directly from you, both offline and online, including when you create a TreeDM account to access TreeDM products and services or attend a TreeDM-sponsored event. Information about you may also be provided to TreeDM by selected third parties, such as data aggregators who may not have a direct relationship with you or by third parties who collect information about you on behalf of TreeDM, such as when you download a TreeDM white paper.

The specific information about you that TreeDM may collect and process based on your interaction with TreeDM includes the following:

  • Name and physical address, email addresses, and phone numbers;
  • Demographic attributes if associated with personal information that identifies you;
  • Photographs identifying you and testimonials;
  • Transactional data such as products and services ordered, financial data, and payment methods;
  • Company data such as the name, size, and location of the company you work for and your role within the company, as well as publicly available company information and activities associated with company data;
  • Survey data collected by TreeDM or by third parties on behalf of TreeDM, and publicly available information such as social media posts;
  • Call recordings and chat transcript data from Sales and customer support calls, as well as live chat sessions or interviews;
  • Unique identifiers, such as your mobile device identifier or browser cookie identifier;
  • IP address and information derived from the IP address, such as geographic location;
  • Information about a device you use, such as browser, device type, operating system, presence or use of “apps,” screen resolution, and preferred language;
  • Certain location or geolocation information you provide directly or through automated means if you choose to enable location-based services from the device or TreeDM application; and
  • Behavioral data about the Internet-connected device you use when interacting with the sites, such as advertisements viewed or clicked, areas of the sites and content, date and time of activities, or the web search used to locate and navigate to a site.

Online information about you or the device you use may also come from the use of cookies and similar technologies (e.g., pixel tags and device identifiers) on our sites or third-party sites.

Please note that TreeDM does not control the content you post to TreeDM community forums or social media; in some cases, such content will be publicly available on the Internet. You should carefully consider whether you wish to submit personal information to these forums or social media and tailor any content you submit accordingly.

WHY AND FOR WHAT PURPOSE IS YOUR PERSONAL INFORMATION USED?

We may use your personal information for the following business purposes:

  • Communicating and responding to requests and inquiries to TreeDM;
  • Creating and managing a TreeDM single sign-on (SSO) account (also referred to as a “TreeDM Account”) and offering functionality on our sites and for technical and functional management;
  • Transacting with customers, suppliers, and business partners, including processing orders for TreeDM products and services;
  • Analyzing, developing, improving, and optimizing the use, function, and performance of our sites, products, and services;
  • Managing the security and operation of our sites, facilities, networks, and systems; and
  • Complying with applicable laws and regulations and operating our business.

We may use your personal information for the following commercial purposes:

  • Administering subscriptions to TreeDM publications and newsletters;
  • Marketing our products and services or related products and services and tailoring our marketing and sales activities to your or your company’s interests; and
  • Providing selected business-to-business services to TreeDM customers using publicly available information about companies, which may include personal information such as the name of a company’s CEO that is publicly available.

WHEN AND HOW IS YOUR PERSONAL INFORMATION SHARED?

Sharing with Third Parties

We may share personal information with the following third parties for business purposes:

  • External service providers (e.g., credit card processing services, order processing, analytics, event/campaign management, website management, IT, and related infrastructure provisioning, customer service, email delivery, auditing, and other similar service providers) to perform business functions on behalf of TreeDM;
  • Relevant third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings);
  • As required by law, to comply with a subpoena or other legal process, if we believe disclosure is necessary to protect our rights, ensure your safety or the safety of others, investigate fraud, or respond to government requests, including public and government authorities outside your country of residence, for national security and/or law enforcement purposes.

We may share personal information with the following third parties for commercial purposes:

  • TreeDM distributors or resellers for further follow-up related to user interests, specific partners offering complementary products and services, or third parties to facilitate interest-based advertising; and
  • Event partners or sponsors of conferences for TreeDM events, such as when you scan your badge in a sponsored session room.

If we provide access to personal information to third parties, we will take appropriate contractual, technical, and organizational measures to ensure that personal information is processed only to the extent necessary and in accordance with this Privacy Policy and applicable law.

WHAT COOKIES AND SIMILAR TECHNOLOGIES ARE USED ON OUR SITES?

TreeDM and our advertising technology partners use cookies and similar technologies (e.g., pixel tags and device identifiers) to recognize you and/or your devices on, off, and across different services and devices for the purposes specified in Section 5 above.

When Are Cookies and Similar Technologies Used?

Cookies are small text files containing a string of characters that uniquely identify a browser on an Internet-connected device. Cookies will also be placed in your browser when you visit TreeDM and non-TreeDM sites that host our plugins or tags. Depending on your jurisdiction, you may be presented with different consent options, including the option to reject all non-essential cookies, before TreeDM places cookies in your browser.

We use cookies and other technologies on all our sites to ensure the best and safest possible experience on our sites and to provide you with personalized information about our products and services. Additionally, TreeDM uses cookies or similar technologies on its sites to collect online information, such as mobile device identifier, IP address, and other information about the device, as well as usage behavior data from your device on our sites (e.g., pages visited, links clicked, or documents downloaded).

WHAT ARE YOUR PRIVACY RIGHTS?

You have several privacy rights available to you, subject to applicable law, regarding the information we process about you:

  • Object to the Use or Sharing of Your Personal Information
    • You can withdraw consent you have previously provided for the use of your personal information, including for TreeDM’s email marketing initiatives.
  • Deletion of Personal Information
    • You can request the deletion or removal of all or part of your personal information.
  • Change or Correct Personal Information
    • You can edit some of the information about you. You can also request the modification, update, or correction of your personal information in certain cases, especially if it is inaccurate.
  • Object, Limit, or Restrict the Use of Your Personal Information
    • You can ask us to stop using all or part of your personal information (e.g., if we have no legal right to keep using it) or limit its use (e.g., if the information is inaccurate).
  • Right to Access and/or Receive Your Information
    • Additionally, you can request a copy of your information and a copy of your information in digital format if you are in the EU, California, or any other jurisdiction that legally grants you that right.
